These Terms and Conditions ("Terms") govern your access to and use of Filmique’s services, website, and any related offerings (collectively, the “Services”).
In short: these Terms explain how bookings work, what clients can expect from a Filmique experience, and how finished films may be used and shared. By booking, accessing, or using Filmique, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use the Services.
1. About Filmique
Filmique provides cinematic travel films and experience-driven video services for individuals, couples, families, and small groups. Services are creative in nature and are intended to document real moments as they naturally occur.
2. Bookings & Eligibility
The following booking requirements exist to confirm availability, protect scheduling commitments, and ensure a smooth experience for both the client and Filmique.
You must be at least 18 years old to book Filmique services.
Bookings are confirmed only once payment (or deposit, where applicable) has been received and acknowledged.
Filmique reserves the right to decline a booking at its discretion.
3. Payments & Pricing
All prices are listed in USD unless otherwise stated.
Full payment or a stated deposit is required to secure a booking date.
Prices may change at any time prior to booking confirmation.
Any applicable taxes or processing fees will be clearly disclosed at checkout.
4. Cancellations & Rescheduling
Cancellations and changes impact scheduling, travel planning, and availability. The following terms are intended to balance flexibility for clients with the logistical commitments required to deliver each Filmique experience.
Client Cancellations
Cancellations made more than 14 days before the scheduled experience may be eligible for a partial refund, excluding non-refundable deposits.
Cancellations made within 14 days of the scheduled experience are non-refundable.
Rescheduling
Clients may request one reschedule with at least 7 days’ notice, subject to availability.
Additional rescheduling requests may incur fees or be declined.
Filmique Cancellations
If Filmique must cancel due to illness, emergency, or unforeseen circumstances, the client will be offered a full refund or rescheduled experience.
5. Weather & Uncontrollable Conditions
Filmique experiences often occur outdoors. Weather conditions are considered part of the natural environment being documented.
Experiences will proceed in most weather conditions unless deemed unsafe.
Weather-related rescheduling is at Filmique’s discretion.
No refunds are guaranteed due to weather preferences or aesthetic expectations.
6. Creative Approach & Editorial Discretion
Filmique works in a documentary-style manner, capturing moments as they naturally unfold. Because of this observational approach, specific shots, moments, or outcomes cannot be guaranteed, and each film is shaped by what genuinely occurs during the experience.
All editing decisions, including pacing, music selection, color grading, and overall tone, are at Filmique’s sole discretion, unless otherwise stated.
Revision requests are limited to minor adjustments unless otherwise agreed in writing.
7. Delivery & Turnaround
Typical delivery timelines will be communicated at the time of booking.
Delivery timelines are estimates and may vary due to travel, volume, or unforeseen circumstances.
Final films are delivered digitally via a private download or viewing link.
8. Usage Rights & Licensing
Client Rights
Clients receive a personal-use license to share their film with friends, family, and on personal social media platforms.
Commercial use, paid promotion, or brand usage is not permitted unless explicitly licensed.
Filmique Rights
Filmique retains full copyright to all footage and finished films.
Filmique may use clips or stills for portfolio, website, marketing, and promotional purposes unless the client requests otherwise in writing prior to delivery.
9. Client Conduct
Clients agree to act respectfully and lawfully during the experience.
Filmique reserves the right to terminate an experience without refund if unsafe, abusive, or illegal behavior occurs.
10. Locations & Permissions
Clients are responsible for securing access permissions for private locations.
Filmique is not liable for restrictions imposed by public or private venues.
11. Assumption of Risk
You acknowledge that filming may occur in public spaces, during travel, or in environments that carry inherent risks. You voluntarily assume all risks associated with participation.
12. Limitation of Liability
To the fullest extent permitted by law:
Filmique shall not be liable for indirect, incidental, or consequential damages.
Filmique’s total liability shall not exceed the amount paid for the Services.
13. Force Majeure
Filmique shall not be held liable for delays or failures caused by events beyond reasonable control, including but not limited to natural disasters, government restrictions, strikes, or transportation failures.
14. Privacy
Personal information is handled in accordance with Filmique’s Privacy Policy. Filmique does not sell or misuse client data.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles.
16. Changes to These Terms
Filmique may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.
